Terms of Service — KéjaLink

1. Agreement to terms

By accessing or using KéjaLink ("the Platform"), you agree to be bound by these Terms of Service and all applicable Kenyan laws and regulations. If you do not agree, you may not use the Platform.

These terms constitute a legally binding agreement between you and KéjaLink. We reserve the right to update these terms at any time with notice to users.

2. Description of service

KéjaLink is a verified house listings platform that connects tenants seeking rental accommodation with landlords in Kenya. Our key service features include:

Verified property listings with physical verification by our moderation team
Landlord identity and property verification
Tenant contact unlock to reveal landlord contact details
Property scoring and ranking based on quality metrics

KéjaLink is a listings platform only. We are not a real estate agent, property manager, or party to any rental agreement between landlords and tenants.

3. User accounts

3.1 Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Kenyan law to use KéjaLink.

3.2 Account responsibility

You are responsible for maintaining the confidentiality of your account credentials
You must provide accurate and truthful information when creating your account
You must notify us immediately of any unauthorised use of your account
One person may not maintain multiple accounts

3.3 Account termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are inactive for more than 24 months.

4. Landlord terms

4.1 Application and verification

To list properties on KéjaLink, you must apply and be approved as a landlord. Our moderation team will physically verify your properties before they are listed. You agree that:

All information provided in your application is accurate and truthful
You own or have the legal right to list the properties
You consent to physical verification visits by our moderators

4.2 Listing requirements

All property listings must:

Accurately represent the property condition, size and amenities
Show real, unedited photographs taken during verification
State the correct monthly rent with no hidden charges
Be updated promptly when availability changes

4.3 Prohibited listings

You may not list:

Properties you do not own or have no right to rent
Properties that do not exist or have been misrepresented
Properties used for illegal purposes
Properties that discriminate on the basis of race, religion, gender, disability or other protected characteristics under Kenyan law

5. Tenant terms

5.1 Contact unlocks

When you unlock a landlord's contact details, you agree that:

The contact information is for your personal use only
You will not share, resell or misuse landlord contact details
You will contact landlords only for legitimate rental enquiries
Unlocking a contact does not create any rental agreement

5.2 Your responsibility

KéjaLink verifies properties and landlords but cannot guarantee every aspect of a rental arrangement. You are responsible for conducting your own due diligence before entering into any rental agreement. We strongly recommend viewing a property in person before making any payment to a landlord.

6. Prohibited conduct

You must not:

Post false, misleading or fraudulent content
Impersonate another person or entity
Use the platform to scam, defraud or harass other users
Scrape, copy or harvest data from the platform without permission
Attempt to reverse engineer or compromise our systems
Use automated tools to access the platform
Violate any applicable Kenyan law or regulation
Engage in any activity that disrupts platform operations

7. Intellectual property

All content on KéjaLink including the platform design, code, logos, and text is owned by KéjaLink or its licensors and is protected under Kenyan intellectual property law. You may not copy, reproduce or distribute our content without written permission.

Property images uploaded by our moderators are owned by KéjaLink and may not be downloaded or used without permission.

8. Limitation of liability

KéjaLink provides the platform "as is" without warranties of any kind. To the maximum extent permitted by Kenyan law, we are not liable for:

Any rental disputes between landlords and tenants
Inaccuracies in property listings despite our verification efforts
Financial losses arising from rental transactions
Platform downtime or technical issues
Fraudulent activity by third parties

Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Dispute resolution

Any disputes arising from these terms shall be governed by Kenyan law. We encourage users to first attempt resolution by contacting us at legal@kejalink.co.ke. Unresolved disputes shall be subject to the jurisdiction of Kenyan courts.
